TERMS AND CONDITIONS
inSync - a Workout Worthy Program

By enrolling in inSync ("Program") offered by Workout Worthy, LLC ("Company"), you agree to the following Terms and Conditions ("Agreement"). Please read them carefully before enrolling.

1. PARTICIPANT CONDUCT

We are committed to providing all participants with a positive experience. Thus, Workout Worthy may, at its sole discretion, limit, suspend, or terminate your participation in any of its programs, live, recorded, social-based, or digital without refund or forgiveness of remaining payments if:

  • You become disruptive or difficult to work with;
  • You fail to follow the program guidelines; or,
  • You impair the participation of our instructors or participants in our program(s).

2. PRIVACY AND CONFIDENTIALITY

We respect your privacy and insist that you respect the privacy of fellow Program participants. You agree:

  • Not to infringe any Program participants' or the Company's copyright, trademark, patent, trade secret, or other intellectual property rights;
  • That any Confidential Information shared by Program participants or any representative of the Company is confidential and proprietary, and belongs solely and exclusively to the Participant who discloses it or the Company;
  • Not to disclose such information to any other person or use it in any manner other than in discussion with other Program participants during Program sessions;
  • That all materials and information provided to you by the Company are its confidential and proprietary intellectual property, and may only be used by you as authorized by the Company;
  • The reproduction, distribution, and sale of these materials by anyone but the Company is strictly prohibited;
  • That if you violate, or display any likelihood of violating, any of your agreements contained in this paragraph, the Company and/or the other Program participant(s) will be entitled to injunctive relief to prohibit any such violations to protect against the harm of such violations.

While you are free to discuss your individual results from our programs and training, you must keep the experiences and statements, oral or written, of all other participants in the strictest of confidence.

Your participation is also subject to our Privacy Policy and Terms of Use.

3. PROGRAM CONTENT

  • Program education and information are intended for a general audience and do not purport to be, nor should they be construed as, advice or counseling tailored to any specific business or industry.
  • All materials, procedures, policies, and standards, all manuals, all teaching aids, and the like that have been or will be made available by Workout Worthy or its designated facilitators, or any other source, oral or written, are for individual use in or in conjunction with this training program only.
  • Program content is for individual use only and may not be sold, tape-recorded, videotaped, shared, taught, given away, or otherwise divulged without the express written consent of Workout Worthy or its designated agent.
  • The information contained in program material is strictly for educational purposes. Therefore, if you wish to apply (or not apply) ideas contained in this material, you are taking full responsibility for your actions.
  • We assume no responsibility for errors or omissions that may appear in any program materials.

4. PHYSICAL ACTIVITY AND HEALTH DISCLAIMER

  • Exercise involves inherent risk of injury. By participating in inSync, you confirm that you are physically able to participate in an exercise program and that you assume all risk of injury to yourself that could result. You are encouraged to consult a physician before beginning any new exercise or nutrition program, particularly if you have any pre-existing medical condition. On-screen demonstrations by Nikki Polos or any instructor are demonstrations only and are not personalized medical or fitness prescriptions for any individual participant.

5. OFFER AND PAYMENT TERMS

  • inSync is a 90-day virtual transformation providing coaching, accountability, and private community access. Any live events included in the Program do not roll over if unattended.
  • The Founding Member fee is a one-time payment of $997, covering the full 90-day inSync transformation. This price is subject to change for future enrollees; the price you were quoted at signup is the price you pay.
  • You agree that no pauses or suspensions will be made once this Agreement is accepted. If you move, stop your current business, decide you no longer wish to participate, or for any other reason, no pauses or cancellations will be made to payments already due. Pauses and suspensions are at the sole discretion of Workout Worthy.

6. CONTINUED MEMBERSHIP (AUTOMATIC RENEWAL)

  • After your 90-day inSync transformation ends, your access to the inSync community and membership continues at $47/month, billed automatically to your original payment method, unless you cancel.
  • You may cancel your monthly membership at any time before your next billing date by emailing Workout Worthy at nikkipolos@workoutworthy.com; your access continues through the end of the period already paid for, and you will not be billed again.
  • If you do not cancel prior to a renewal date, your membership will continue for another monthly term under these same Terms and Conditions.

7. DISCLAIMERS AND LIMITATION OF LIABILITY

  • Workout Worthy makes no guarantees regarding specific outcomes or results from participation in inSync.
  • You acknowledge that your results depend on individual effort, consistency, starting point, and other factors beyond our control.
  • Workout Worthy shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising from your participation in the Program.

8. FORCE MAJEURE

  • Workout Worthy shall not be held responsible for delays or failure in performance resulting from acts beyond its reasonable control, including but not limited to natural disasters, government restrictions, pandemics, cyber-attacks, internet or platform outages, or labor disputes.

9. NO LEGAL, FINANCIAL, OR MEDICAL ADVICE

  • Any coaching, strategies, or guidance provided within inSync are for informational and educational purposes only.
  • You should seek professional advice from a physician, and from legal, financial, tax, or other certified professionals, before making decisions based on Program content.

10. MODIFICATIONS TO THIS AGREEMENT

  • Workout Worthy reserves the right to modify these Terms at any time. Updated terms will be posted on our website, and continued participation in inSync constitutes acceptance of the updated terms.
